Episode summary

Drawing on Law, Legislation and Liberty, Samuel Woodall and Jack Thomson distinguish general rules that emerge through social practice from commands deliberately enacted to produce particular outcomes. Hayek’s contrast between law and legislation supports his wider argument about dispersed knowledge and the limits of political planning.

The episode also tests the democratic implications of that position. If elected majorities can threaten the rule of law, what should constrain them? Hayek’s answers continue to structure disputes about markets, state power, constitutionalism and freedom.

Questions explored

  • What is the difference between spontaneous order and planned organisation?
  • Why does Hayek distinguish law from legislation?
  • Can democratic majorities undermine the rule of law?
  • What are the limits of Hayek’s argument against purposive social planning?

Participants

  • Samuel Woodall: intellectual historian and co-host of Beyond the Text.
  • Jack Thomson: philosopher and co-host of Beyond the Text.
